One of the most contentious issues in divorce is often child custody, which provides parents with the rights regarding the physical and legal custody of their children. Additionally, visitation rights (or parenting time) define the right of non-custodial parents to visit their children. Custody and Visitation can be determined through agreements reached through negotiation between the parties, or, in the event that an agreement is not or cannot be reached, by the Family Court based on what it determines is in the best interests of the children following a trial. Either way, it is important to have appropriate representation as you negotiate these issues in the Court system.

Legal custody determines the right of a parent to make decisions regarding the health, safety and welfare of a child. Physical custody determines which parent will have actual physical custody of the child. Factors that go into determining custody often include:

  • Income and financial issues
  • Any parental agreements
